    CMHA National welcomes and appreciates community giving through third-party fundraising initiatives or events. These terms and conditions apply to all those who host or organize a fundraising event or carry out a fundraising initiative on behalf of CMHA National.
    1. I/We understand that all fundraising initiatives or events for the benefit of CMHA National and related activities must be approved in advance by CMHA National. I/We have/will submit in writing a proposal form including the concept and details about the initiative or event and a list of sponsors, if any.
    2. I/We agree to provide the net proceeds to CMHA National within 60 days after the event is over. I/We will maintain an accounting to provide to CMHA National upon request. The accounting will include all revenues, expenses, and donations (including gifts of goods or services) of my initiative or event. I/We understand that no third-party revenues or expenses will flow through CMHA National and that I/we cannot name CMHA, National in or sign contracts on behalf of CMHA National. I/We confirm that any expenses incurred to run the initiative or event will be reasonable and transparent. I/We acknowledge that any expenses incurred in hosting the initiative or event are my/our responsibility and that CMHA National is not responsible for any losses that I/we may incur in hosting the initiative or event. I/We will clearly identify to participants of the initiative or event that the net proceeds will be given to CMHA National.
    3. I/We understand that CMHA National must strictly follow guidelines set by the Canada Revenue Agency and acknowledge that charitable tax receipts for events cannot be issued in every circumstance. I/We agree to follow CMHA National’s tax receipting policy and will direct any questions about receipting to CMHA National.
    4. I/We acknowledge and agree CMHA National shall not be held liable for any injury, loss or damage resulting from my initiative or event. I/We shall indemnify and hold harmless the Canadian Mental Health Association, National its officers, directors, and employees, from and against any and all claims, liabilities, costs, fines and expenses (including reasonable legal fees) arising out of any claims or suits, or threats of suits which may be brought against CMHA, National for any reason whatsoever in connection with the fundraiser including, but not limited to, claims related to personal injury related to the fundraiser.
    5. I/We agree to conduct my initiative or event in a safe manner and to adhere to all federal, provincial, and municipal laws. I/We will obtain all necessary permits and licenses for my initiative or event. I/We will obtain any necessary insurance for my initiative or event.
    6. I/We understand that CMHA, National name and related logos are trademarks of CMHA, National. Such trademarks cannot be used without the prior written approval of CMHA, National. I/We will submit all promotional materials for the proposed initiative or event to be approved by CMHA, National in writing prior to being released to the public. I/We understand that the name CMHA, National is not permitted on any product packaging. Promotional materials may not imply that CMHA, National is involved in the initiative or event as anything other than a beneficiary of the proceeds, and must clearly state the percentage of proceeds or portion of ticket price that will be donated to CMHA, National.
    7. I/We acknowledge that CMHA, National will provide limited technical support but that I/we are expected to administer my/our own online fundraising page (e.g. post information, send email requests).
    8. I/We give permission to CMHA, National to use the photographs and content, as submitted by me, in CMHA, National’s online and offline materials.
    9. I/We acknowledge that CMHA, National does not permit the following types of fundraising in a third-party context:
      1. Programs that raise money on commission;
      2. Events that encourage/involve behaviour that is counter to the CMHA, National mission and/or programmatic activities;
      3. Events involving the promotion or support of a political party or candidate, or those which appear to endorse a political activity;
    10. I/We will notify CMHA, National as soon as reasonably possible in the event that the fundraising initiative or event is cancelled or rescheduled. In the case of an event, notification will be at least 24 hours prior to the original date of the event.
    11. I/We acknowledge that CMHA, National in its sole discretion, may deny my/our application and may revoke an accepted application at any time. If CMHA, National revokes its approval, I/we agree to immediately cease all use of any of the CMHA, National trademarks and to immediately give CMHA, National any funds raised and an accounting of funds raised.
    12. I/We acknowledge that my/our obligations hereunder shall survive the termination of this agreement.
