  1. Can I leave a legacy gift to CMHA without affecting what I leave my heirs? 

Yes, there are many ways you can fulfill your charitable goals while at the same time providing for your loved ones. Attractive options exist for legacy giving, allowing you to leave meaningful gifts to the CMHA and to family members, while providing you with generous tax benefits. 

  1. Must I have an estate to make a legacy gift? 

 “Estate” is simply a term used to describe any property, money or personal belongings that you have at the time of your death. Most people leave an estate when they die, even though they may not have a great deal of wealth. It is important to remember that there is no such thing as an insignificant gift. Anyone can arrange to leave a charitable gift from his or her own estate – no matter the size.  

  1. How can I leave a legacy gift to CMHA? 

There are many ways to make a meaningful legacy gift – the most common is through a will. Some people specify a dollar amount, while others leave a percentage of their estate or any assets that would be left over after they have provided for their families. You can also fund a gift with investment assets, life insurance or other property such as real estate.  

  1. Do I have to state my gift intention in my will?  

Yes. To be certain that we eventually receive your legacy gift, you should state this intention in your will. Without a will, you have no control over your assets after your death and your estate will be settled according to provincial laws – regardless of your wishes. 

  1. Is there specific wording I should use in my will? 

Yes. You will need to consider the type of bequest you want to make, and state it clearly. Your financial advisor or lawyer can also help. More examples can be found here. 

“I give the Canadian Mental Health Association, National (CMHA) [the sum of _______] or  [_______% of the residue of my estate].”

 6. Who can help me arrange a legacy gift? 

You can talk to a financial planner, lawyer, accountant, trust officer or insurance agent about a legacy gift to CMHA. These advisors can explain the many tax and planning benefits to you and can help you with ideas on how to leave a legacy gift that is meaningful to you. You may also contact us for more information and assistance.  

  1. Should I tell CMHA of my gift intention? 

This is entirely a personal decision. CMHA would find it helpful to know of your legacy gift intention so your generosity can be appropriately recognized. However, the decision to advise us of your intentions is yours to make.
